Terms of Service

1. Agreement to Terms

By accessing or using the PhotoSelector website, Studio Dashboard, API, white-labeled websites, or any associated tools ("the Service"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

PhotoSelector provides a suite of tools for photographers and their clients, including:

• Photo Selection & Culling: Intuitive swipe-based tools for clients to select their favorite photos.
• Studio Dashboard: CRM, project management, lead tracking, and client communication tools for photographers.
• Guest Cam: Tools for collecting guest photos via QR codes and facilitating event engagement.
• Client Galleries: Hosting and sharing of selected images with secure access.
• White-Labeled Websites: Custom-branded portfolio websites with your domain, logo, and branding.
• WhatsApp Communication: Integrated messaging for gallery sharing, client invites, and lead notifications.

3. Accounts & Security

You are responsible for safeguarding the password and credentials used to access the Service and for any activities or actions under your password. You agree not to disclose your password to any third party.

Team members may be invited to your organization account. You are responsible for the actions of all team members you invite to your account.

5. Pricing, Subscriptions & Payments

A. Free Plan

The free plan includes unlimited projects, 1GB storage, and access to pay-per-use features such as client invites, WhatsApp sharing, and guest QR uploads.

B. Subscriptions (Studio Pro)

Paid subscriptions are billed on a recurring monthly basis. Subscriptions include access to white-labeled portfolio websites, custom domains, increased storage, and included credit quotas.

C. Credit Packs & Add-Ons

You may purchase credit packs and add-on bundles for additional WhatsApp messages, client invites, guest links, and other features. Credits do not expire for paid subscribers (unlimited rollover).

E. Cancellation

You may cancel your Subscription at any time through your account settings. Upon cancellation, your Subscription will continue until the end of your current billing period. You will not be charged again, but no refunds will be issued for the remaining period.

6. White-Labeled Website Terms

If you use our white-labeled portfolio website feature:

• You are responsible for the content you publish on your white-labeled website.
• You must have the rights to use any logos, images, and branding you upload.
• Custom domains require proper DNS configuration on your end.
• We reserve the right to display a discreet "Powered by PhotoSelector" attribution on free plan websites.
• Your white-labeled website will remain active as long as your subscription is active.

7. Content & Conduct

You retain ownership of all photos and data you upload. By using the Service, you grant us a license to host, process, and display this content solely for the purpose of providing the agreed services to you and your clients.

You represent and warrant that you own or have the necessary rights to use and share all content you upload to PhotoSelector.

You agree not to upload or share any content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

8. Limitation of Liability

To the maximum extent permitted by applicable law, PhotoSelector shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

9. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
